For a civil marriage contract, the following conditions must be met
- Both the husband and wife must reach the legal age of (21) - twenty-one years - at least, and this is proven by any official document issued by the country to which each of them belongs by nationality.
- Marriage shall not be to brothers, sons, grandchildren, paternal uncles, uncles, or any other cases specified by the executive regulations of this decree-law.
- That each of the spouses explicitly expresses before the documentation judge his consent to the marriage and that there is no legal impediment that prevents this from taking into account his consent.
- The spouses’ signature on the disclosure form prepared for this purpose.
Marriage contract procedures:
- Marriage contract procedures may be held before the notarization judge of the competent court by submitting a request according to the form prepared for this purpose. This form is bilingual for civil marriage.
- The marriage is performed by the spouses filling out the form prepared for this purpose before the documentation judge. The spouses have the right to agree to include in the contract conditions that will be taken into account between them, including the rights of the wife and husband during the duration of the marriage and the rights after the divorce, in particular the expenses and joint custody of the children.
- The marriage contract form must also include the disclosure of each spouse about the existence of any other previous marital relationship for either of them, indicating the date of the divorce, if any, and the wife’s acknowledgment that there is no existing marital relationship. The husband must also submit a declaration in the event that his legislation does not allow him to do so. Polygamy. In all cases, the husband must disclose any existing marital relationship before the documentation judge
- The contract must also include evidence of the consent of both parties to the contract, verbally and in writing.
- After fulfilling all the stipulated conditions and procedures for the marriage contract, the authentication judge will ratify the marriage contract and record it in the register prepared for this purpose.
